Mr. Timothy M. Cerio, General Counsel
Office of the General Counsel
4052 Bald Cypress Way, BIN A02
Tallahassee, FL 32399-1703

Dear Mr. Cerio:

It is imperative you understand that Florida Statutes Chapter 462.17 pertains to pseudo- naturopathy, which is under the jurisdiction of the state.  In contradistinction, traditional naturopathy is under the jurisdiction of the Naturopathic National Council, Inc. by authorization of Federal Trademark Registration No. 3,047,099 and the Tenth Amendment to the United States Constitution. Accordingly, the State of Florida’s use of the term naturopathy to label a practice that violates the quintessence of naturopathy causes trade identity confusion in violation of 15 USCA §1125(a) of the Lanham Act.

No response within ten (10) days of receipt of this letter or further opposition to the NNC’s right to license traditional naturopaths will escalate this matter to a law suit against the State of Florida.

Cordially,

Beverly Betancur, N.D.
Chief Executive Officer
